Every year between March and May, millions of Malaysians file their taxes through LHDN’s e-Filing portal. And every year, a good chunk of those filers discover they have overpaid their PCB (Monthly Tax Deduction) and are owed money back.

For most people, the refund hits the bank account and disappears into daily expenses within a week. Groceries, a holiday, a gadget.

But what if you redirected that refund toward the single biggest purchase of your life?

Your tax refund can be the seed money that makes homeownership real. Not someday. This year.

This guide walks you through exactly how to do it, step by step, using strategies that are specific to the Malaysian tax and property system in 2026.

How Much Could Your Tax Refund Actually Be?

If your employer has been deducting PCB throughout the year and you claimed all your eligible tax reliefs (lifestyle, medical, EPF, insurance, education), there is a real chance your actual tax liability is lower than what was already deducted.

That difference is your refund.

LHDN does not publish an “average refund per individual” figure. But the scale tells the story. In the first half of 2025, LHDN returned RM9.35 billion across more than 3 million taxpayers. The government paid out RM22.45 billion in total tax refunds for the full year of 2025, which was the highest amount in five years.

Even a refund of RM2,000 to RM5,000 can move the needle when you combine it with the right strategy.

Curious how far your salary can stretch for a home loan? Check how much home loan you can get based on your salary.

Why Your Tax Refund Is Perfect for a Down Payment

Your tax refund is essentially forced savings. It is money you earned but never saw in your monthly budget. That makes it psychologically easier to redirect, because you were never counting on it for rent or food.

Here is why it works so well for a down payment specifically.

The standard down payment in Malaysia is 10% of the property price. On a RM400,000 home, that is RM40,000. On a RM300,000 home, RM30,000. Those numbers feel massive when you are saving RM500 a month. But a RM3,000 tax refund deposited into a dedicated down payment fund every year for three years is already RM9,000, before interest.

The real magic happens when you stack your refund with other money you are entitled to but may not be using. More on that below.

Step-by-Step: Turning Your Tax Refund Into a Down Payment

Step 1: Maximise your tax reliefs before you file

Your refund size depends on how many reliefs you claim. Many Malaysians leave money on the table because they do not keep receipts or do not know what qualifies.

For YA 2025 (filed in 2026), key reliefs include RM9,000 automatic personal relief, up to RM4,000 for EPF contributions, up to RM3,000 for life insurance or takaful, up to RM2,500 for lifestyle expenses (books, gadgets, internet), up to RM8,000 for SSPN deposits, and medical expenses for parents up to RM8,000.

Claim everything you are entitled to. The difference between a RM500 refund and a RM3,000 refund is often just a few receipts you forgot to keep.

Need a walkthrough? See our full list of personal income tax reliefs for 2026.

Step 2: Open a dedicated “down payment” savings account

Do not let the refund land in your regular spending account. Open a separate high-yield savings account or a fixed deposit and label it “home fund.”

The moment LHDN processes your refund (typically within 30 working days of e-Filing), transfer it immediately. This is the single most important behavioural change. Money that stays visible in your daily account gets spent.

Step 3: Use the calculator to set your target

Before you can plan, you need a number. Use the calculator below to figure out exactly how much you need to save, how long it will take, and what your monthly contribution should be.

Estimates for guidance only. Actual figures depend on the bank’s assessment, current rates, and your full financial profile.

Step 4: Stack your refund with EPF Account 2

This is where many first-time buyers unlock a breakthrough they did not expect.

EPF allows you to withdraw from Account 2 to fund a home purchase. This covers down payments, stamp duty, and even monthly loan instalments through the Flexible Housing Withdrawal scheme.

The minimum balance required is just RM500 in Account 2. For first-time buyers, this falls under Category 1, which covers the down payment plus an additional 10% for stamp duty and legal fees.

So your equation becomes: tax refund + EPF Account 2 withdrawal + personal savings = down payment covered.

Want the full breakdown on EPF housing withdrawal? Read our step-by-step EPF Account 2 withdrawal guide.

Step 5: Claim the stamp duty exemption to keep more cash

If you are a first-time Malaysian buyer purchasing a home priced at RM500,000 or below, you qualify for a 100% stamp duty exemption on both the Memorandum of Transfer (MOT) and the loan agreement. This exemption has been extended under Budget 2026 until 31 December 2027.

On a RM500,000 home, this saves you approximately RM11,000 in fees that would otherwise eat into your cash reserves on top of the down payment.

That RM11,000 you do not have to pay? It stays in your pocket. Which means your tax refund stretches even further.

Understand how this exemption works in detail. Read our stamp duty exemption guide for 2027.

The Tax Relief That Pays You Back After You Buy

Here is the part most people miss entirely.

Under Budget 2025, the government introduced a new income tax relief on home loan interest payments for first-time buyers. If your SPA is signed between 1 January 2025 and 31 December 2027, you can claim up to RM7,000 per year in tax relief on the interest portion of your home loan for homes priced up to RM500,000. For homes priced between RM500,001 and RM750,000, the cap is RM5,000 per year.

This relief is claimable for three consecutive years starting from the year you first pay the housing loan interest.

Think about what this means in practice. You use your 2025 tax refund to help fund the down payment. You buy the house. Then for the next three years, your home loan interest reduces your taxable income, which generates even bigger refunds that help you manage the new mortgage.

Your refund funds the house. The house funds bigger refunds. It is a virtuous cycle.

Two conditions to note: the property must be for your own residence (not rented out), and homes above RM750,000 do not qualify for this relief.

What Does This Look Like With Real Numbers?

Let us walk through a worked example for a first-time buyer earning RM5,000 per month (RM60,000 per year) eyeing a RM400,000 apartment.

Item

Amount (RM)

Down payment (10%)

40,000

Estimated tax refund (YA 2025)

2,800

EPF Account 2 withdrawal (estimated)

25,000

Stamp duty savings (100% exemption)

~9,000 saved

Personal savings needed

~12,200

Annual tax relief on loan interest (3 years)

Up to 7,000/year

Without the refund, the EPF withdrawal, and the stamp duty exemption, you would need to save RM49,000 or more in cash. With these three tools combined, the gap drops to around RM12,200 in personal savings.

And for the next three years, the home loan interest relief puts up to RM7,000 back into your tax calculation annually, which translates to real ringgit savings depending on your tax bracket.

Can You Buy a House With Zero Down Payment?

For some buyers, yes. Government schemes like SJKP (Skim Jaminan Kredit Perumahan) provide 100% financing for eligible first-time buyers. Certain developers also offer zero-entry or rebate packages that effectively absorb the deposit.

But “zero down payment” does not mean zero cost. Legal fees, valuation fees, and moving expenses still apply. Your tax refund can cover those.

Explore all your options. Read our guide on buying a house in Malaysia without a down payment.

How Much Can You Actually Borrow?

Your down payment is only half the equation. The other half is your loan eligibility. Banks assess your Debt Service Ratio (DSR) and credit score before approving a mortgage. Use the calculator below to see where you stand.

Estimates for guidance only. Actual figures depend on the bank’s assessment, current rates, and your full financial profile.

Want to understand the financial jargon before you walk into the bank? Read our guide to financial terms every home buyer should know.

Common Mistakes to Avoid

Spending the refund before it arrives. Do not mentally allocate your refund to a holiday or gadget. The moment you file your taxes, set the expectation that any refund goes into your home fund.

Not claiming all reliefs. Every unclaimed receipt is money you are giving back to LHDN. Start a digital folder on your phone today and photograph every qualifying receipt for the rest of the year.

Ignoring the SPA deadline. The home loan interest tax relief and stamp duty exemption both require SPAs signed by 31 December 2027. If you plan to buy, the clock is ticking.

Draining EPF without thinking about retirement. EPF withdrawal is powerful, but it reduces your retirement savings. Withdraw strategically, not emotionally. Use it for the down payment, but do not empty the account.

Forgetting the “hidden” costs. The down payment is not the only upfront expense. Legal fees, valuation fees, and moving costs add up. Plan for 10% to 18% of the property price as total upfront outlay.

As of 2023, all Malaysians aged 18 and above have already been automatically assigned a Tax Identification Number (TIN) by Lembaga Hasil Dalam Negeri Malaysia (LHDN).

However, the TIN still needs to be verified and activated through the MyTax e-Daftar system before it can be used for official income validation, including commission payments for real estate agents. The activation process is free and typically takes about three working days.

With the implementation of Malaysia’s e-Invoice system in 2026, agencies are now required to validate agents’ TIN details as part of the commission payment process.

Activating your TIN early helps ensure a smoother experience when receiving commission and keeps your records aligned with the latest requirements.

This guide explains what real estate agents need to know about activating their TIN and how to complete the process step by step.

1. What Is a TIN Number?

A Tax Identification Number (TIN) is a unique number issued by Lembaga Hasil Dalam Negeri (LHDN) to record and track your income and tax matters in Malaysia.

For real estate agents, this is especially important. Since commission-based income is not treated the same as a fixed salary, agents are responsible for declaring their own earnings to LHDN. Your TIN ensures your income can be properly recorded and validated under the current system.

Your TIN format:
Individual TIN numbers typically begin with “IG” (Resident) or “OG” (Non-Resident), followed by a series of numbers.

2. Why You Need a TIN (And Why It Matters Today)

The 2026 Reality: Your TIN Supports Smooth Commission Processing

With Malaysia’s e-Invoice system, an activated Tax Identification Number (TIN) is now part of the standard commission payment validation process.

Previously, not having a TIN mainly created compliance risks later on. Today, it may also affect how smoothly your commission payments can be processed.

How the e-Invoice process works:
Agency generates an e-Invoice with your TIN → submits it to LHDN for validation → commission payment proceeds smoothly.

3. What This Means for Real Estate Agents

Without an activated TIN, commission payments may be delayed until the verification process is completed (typically at least 3 working days).

Beyond payment processing, having an active TIN helps you:

Declare income properly

Build a recognized income track record

Stay aligned with LHDN requirements

Bottom line: TIN registration is a standard requirement for all real estate agents earning commission in Malaysia — not just team leaders or top performers.

4. Why You Should Register Early

Registering your TIN early helps ensure your commission process runs smoothly from the start.

Prepared agent timeline:
✅ Day 1: Join agency
✅ Day 2: Register & activate TIN
✅ Day 5: TIN ready for validation
✅ Day 30+: Close deal and get paid smoothly

Delayed setup timeline:
❌ Close deal first, then realise TIN isn’t active
❌ Payment delayed while registering TIN
❌ Wait for activation before commission is processed

Why it matters:
Early registration helps you keep clean income records, stay tax-ready, and build financial credibility from day one.

At the end of the day, it’s not just about closing deals — it’s about getting paid smoothly and building a sustainable career.

👉 Activate your TIN early to set the right foundation.

5. Step-by-Step: How to Register TIN (For Real Estate Agents)

Follow these steps to check for, register, or activate your TIN:

Step 1: Check for an Existing TIN

Important: Since 2023, LHDN has been auto-assigning TINs to all Malaysians 18+. You may already have a TIN assigned to your NRIC—you just need to find it and activate it.

Before starting a new registration, verify if a TIN has already been assigned to you:

Every transaction must be validated with LHDN in real-time. For commission payments, your agency must submit an e-Invoice that includes your TIN. If your TIN is missing or invalid, LHDN’s system rejects the invoice, and the payment cannot proceed.

I just got my first deal—do I need to register immediately?
Yes, before your agency processes the payment. Register your TIN as soon as you join an agency, not after you close your first deal. Processing takes 3 working days, and you’ll need to activate your MyTax account. If an agency falls below this threshold, they may not have transitioned to the e-invoice system yet, and therefore may not request a TIN from their agents for payment processing at this time.

If you run a business in Malaysia and pay commission, incentives, or performance bonuses, there’s one document you cannot afford to ignore: CP58.

Many employers only discover CP58 during audit season — and by then, it’s stressful.

Whether you’re a small business owner, HR executive, payroll officer, or simply trying to understand what CP58 is, this guide explains what it means, who must issue it, and how to stay compliant.

No tax jargon. Just clarity.

Key Takeaways

CP58 is a record of commission or incentive income, not a tax bill.

CP58 income is taxable and must be declared in Malaysia.

The RM5,000 annual threshold determines mandatory issuance.

Missing the 31 March deadline may expose companies to compliance risk.

Understanding CP58 early reduces audit exposure and financial penalties.

CP58 is a statement of monetary and non-monetary incentive payments made to agents, dealers, or distributors.

It is required under Section 83A of the Income Tax Act 1967 and regulated by Lembaga Hasil Dalam Negeri (LHDN)

Its purpose:

Ensure incentive payments are recorded

Support tax transparency

Allow recipients to declare income correctly

CP58 is not issued to salaried employees. It applies specifically to non-employment incentive arrangements.

The total incentive exceeds RM5,000 in a year

The recipient is an agent, dealer, or distributor

Where to Get the CP58 Form

Employers who need to issue CP58 can obtain the official form directly from Lembaga Hasil Dalam Negeri (LHDN).

The CP58 form is publicly available through the LHDN website and can be downloaded as a PDF.

Download the official CP58 form here:
https://phl.hasil.gov.my/pdf/pdfborang/Borang_CP58_Pin_012022_1.pdf

This form contains the required fields for reporting incentive payments, including:

Recipient name and identification number

Total monetary incentives

Non-monetary benefits

Company details issuing the statement

Employers should ensure the form is completed accurately and retained for record-keeping purposes. LHDN generally recommends that companies keep tax-related documents for at least seven years in case of audits or verification requests.

Even responsible companies make CP58 mistakes — usually not because of negligence, but because of misunderstanding.

Here are the most common compliance gaps we see, especially among SMEs and growing businesses.

Mistake 1: Assuming CP58 Only Applies to Large Corporations

The CP58 obligation is based on incentive payment activity, not company size.

If your business:

Pays commission to freelance agents

Provides referral incentives

Rewards distributors

Gives performance-based bonuses outside payroll

You may fall under CP58 requirements, even if you are a small startup.

Why This Is Risky

During an audit, LHDN does not differentiate based on company size

Mistake 2: Failing to Consolidate Incentive Payments Annually

A common operational error is tracking incentive payments monthly but not aggregating them annually.

Example:

You pay RM1,000 commission monthly to an agent.

Individually, RM1,000 does not trigger attention.

But over 12 months:
RM1,000 × 12 = RM12,000

This exceeds the RM5,000 threshold.

If your accounting system does not automatically consolidate annual totals per recipient, you may unknowingly fail to issue CP58.

Why This Is Risky

Failure to issue CP58 when the threshold is exceeded may expose your company to penalties under the Income Tax Act.

Mistake 3: Confusing CP58 With EA Form

This confusion is very common among HR teams.

EA Form applies to employees under payroll.

CP58 applies to agents, dealers, and distributors who are not salaried employees.

Some companies incorrectly:

Issue EA Form to agents

Skip CP58 because they assume payroll reporting covers it

These are separate compliance requirements.

Why This Is Risky

Misclassification may result in:

Incorrect tax reporting

Payroll inconsistencies

Audit complications

Why These Mistakes Happen

Most CP58 non-compliance is not intentional.

It usually happens because:

There is no formal incentive tracking system

HR and finance roles are not clearly separated

The company is growing quickly

There is misunderstanding about agent classification

Fixing systems early is easier than responding to audit letters later.

CP58 vs EA Form: What Employers Must Understand

Item

CP58

EA Form

For

Agents / Distributors

Employees

Covers

Incentives

Salary

Mandatory

Yes (if threshold met)

Yes

Issued By

Company

Employer

Understanding the distinction prevents payroll errors and compliance exposure

Employer CP58 Compliance Checklist

Before 31 March each year, confirm:

☐ All incentive payments are recorded
☐ Total annual incentives per recipient calculated
☐ RM5,000 threshold assessed
☐ CP58 prepared accurately
☐ Copies retained for record (7 years recommended)
☐ Recipients notified

This checklist reduces audit exposure and protects your business.

Malaysia’s tax ecosystem is increasingly data-driven.

Accurate reporting:

Protects your company from penalties

Supports audit readiness

Builds professional credibility

Strengthens governance standards

Incentive-based industries such as property, insurance, and distribution must treat CP58 as part of financial control, not optional paperwork.

Have you received your CP58 form?

Contrary to popular belief, CP58 is not a tax form – it’s an income statement that records all your incomes, whether it be cash or non-monetary incentives.

If you haven’t heard of this form, don’t worry – a lot of people haven’t.

But if you are working as a real estate agent, it’s best that you know (in case tax agents start looking for you).

So what is the CP58 form exactly? Read on to learn more!

What is CP58?

CP58 is essentially an income statement that records all incomes, whether in the form of cash or non-monetary incentives, provided by companies to their agents, dealers, or distributors.

These incentives can range from bonuses and allowances to non-monetary perks like houses, cars, or flight tickets.

Similar to the EA Form issued to employees in the private sector, CP58 serves as a comprehensive record of remuneration for non-employee recipients.

Do I need to fill out CP58?

Thankfully, you don’t have to – but your company does.

According to the Inland Revenue Board of Malaysia (IRBM, or more commonly known as LHDN) …

If you received more than RM5,000 in cash or non-monetary incentives annually, your company has to produce a CP58 form for you.

If you received less than RM5,000, you will only receive the form upon request.

When should I receive my CP58 form?

Your company should provide you the CP58 form by 31st March of the year immediately following the year in which the incentives were paid.

Companies failing to meet this deadline may face legal consequences outlined in the Income Tax Act 1967.

Any payer company which fails to prepare the form CP 58 as required under Section 83A of Income Tax Act 1967 shall be guilty of an offence under Section 120(1)(b) and shall, on conviction, be liable to a fine of not less than RM200 and not more than RM20,000 or to imprisonment for a term not exceeding 6 months or to both.

The responsibility of preparing the CP58 form falls on the payer company—a.k.a the company that disburses monetary or non-monetary incentives to its agents, dealers, or distributors.

How to submit the CP58 form

Here’s where it gets interesting – it’s not mandatory to submit the CP58 form to the IRBM.

However, in case of tax audits, you will want to keep a copy handy for at least 7 years.

What is exempted from the CP58 form?

The following items do not need to be included in the CP58 form:

Credit rebates.

Subcontract payments.

Handling fees.

Trade and bulk discounts.

Promotional items/gifts not stated in the contract with the agents.

Incentives given to the public or customers to encourage them to introduce more customers, eg. referral fee.

Free items that are not based on performance eg. umbrellas, pens, notebook, and calendars.

Preferential rates given as special treatment for independent agents who buy and sell goods on their own.

Special discount rates to independent agents.

Have you heard of e-Invoices?

E-Invoices, short for electronic invoices, are replacing paper and electronic invoices.

It helps businesses work more efficiently and follow tax rules.

Recently, the Inland Revenue Board of Malaysia has come up with the new guidelines for e-Invoice following the announcement of Budget 2024.

In this article, we’ll explore what e-Invoices are and everything you should know about them!

All you need to know about e-Invoice by LHDN

What is e-Invoice?

Benefits of e-Invoice

When will e-Invoices be implemented?

Scenarios and Types of e-Invoices

Conclusion

What is e-Invoice?

An e-Invoice is essentially an electronic version of a transaction record between a seller and a buyer.

It serves the same purpose as its paper or electronic predecessors, like invoices and credit or debit notes, but in a digital format.

Just like a traditional invoice, an e-Invoice includes critical details such as the names and contact information of the seller and buyer, a list of items or services provided, quantities, prices before tax, applicable taxes, and the total amount due.

This digital document is used to keep track of sales and purchases in everyday business activities.

Benefits of e-Invoice

Adopting e-Invoicing offers a smooth experience for taxpayers and enhances business operations while promoting adherence to tax regulations.

Source: LHDN website

When will e-Invoices be implemented?

The introduction of e-Invoicing will occur in stages to ensure a smooth transition.

The implementation schedule has been strategically designed, considering various revenue thresholds, to give taxpayers ample time for preparation and adjustment.

Here’s the phased e-Invoicing implementation plan:

Targeted Taxpayers

Implementation Date

Taxpayers with an annual turnover or revenue of more than RM100 million

1 August 2024

Taxpayers with an annual turnover or revenue of more than RM25 million and up to RM100 million

1 January 2025

All taxpayers

1 July 2025

Scenarios and Types of e-Invoices

The e-Invoice setup is built to handle every aspect of billing and record-keeping digitally, dealing with a range of business situations and types of documents in a straightforward way.

Situations that require an e-Invoice

1. Proof of Income

Issued when a sale or transaction occurs to acknowledge the income of a taxpayer.

2. Proof of Expense

Pertains to the taxpayer’s purchases or expenditures, including returns and discounts. It’s also used for adjustments or deductions from recorded income.

Additionally, in certain cases, taxpayers must generate a self-issued e-Invoice to record expenses from international transactions.

The self-billed e-Invoice will be allowed for the following transactions:

Payment to agents, dealers, distributors etc.

Goods sold or services rendered by foreign suppliers

Profit distribution (e.g. dividend distribution)

e-Commerce transactions

Payout to betting and gaming winners

Acquisition of goods or services from individual taxpayers (who are not conducting a business)

For instance, if a taxpayer procures services from a foreign supplier who doesn’t utilize Malaysia’s MyInvois System, they must self-issue an e-Invoice to record the transaction.

Types of e-Invoices to be issued:

1. Invoice

A formal record detailing a transaction between a seller and a buyer, which may include self-issued e-Invoices for recording expenses like those from foreign suppliers.

2. Credit Note

Issued by sellers to rectify mistakes, grant discounts, or reconcile returns on a previously issued e-Invoice, aiming to decrease the value of the original e-Invoice without involving a cash refund to the buyer.

3. Debit Note

Created to reflect additional charges on an existing invoice.

4. Refund

An e-Invoice confirming the reimbursement of a payment to the buyer, applicable in instances where there is a monetary return to the purchaser.

1. e-Invoice model via MyInvois Portal

MyInvois Portal contains all the functionalities required for taxpayers (supplier) to perform e-Invoice actions (i.e., generate, submit, view, cancel or reject invoice, etc.) and is specifically designed for the following purposes:

Allows all taxpayers to view and search for their respective e-Invoices; and

Provides MSMEs with the capability to issue e-Invoice and taxpayers who are not able to issue an e-Invoice on their own system.

Taxpayers are required to login to MyTax Portal to utilise MyInvois Portal to perform their e-Invoice obligations in accordance with the rules and requirements outlined by LHDN.

2. e-Invoice model via API

API allows taxpayers to submit e-Invoices directly to LHDN.

Taxpayers would need to configure the API integration by setting up call-backs (specific taxpayers system addresses) and log into the available LHDN APIs via the Digital Certificate issued by LHDN (authentication mechanisms).

The structure has been specifically designed to cater to B2B, B2G and B2C transactions to ease procedures for businesses and individual taxpayers.

There are 53 data fields that are required to issue an e-Invoice.

Products / Services

Unique ID Number

In addition, for specific circumstances, an annex will be required to be submitted as part of the e-Invoice to LHDN.
