What are the Stages Involved Before the Registration of MOT?<\/h2>\n\n\n\n<p>Before registering for the MOT, there are a <strong>few stages<\/strong> that a buyer needs to go through.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-i-finding-a-suitable-home-loan-and-lawyer\">i. Finding a suitable home loan and lawyer<\/h3>\n\n\n\n<p>As a buyer, it&rsquo;s important that you find the <strong>best mortgage loan<\/strong> (in the event you need to finance your purchase of property) for you, and <strong>a lawyer is required<\/strong> to assist you in the whole transaction, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Drafting the Sales and Purchase Agreement (SPA)<\/li>\n\n\n\n<li>Loan documents<\/li>\n\n\n\n<li>Stamping of the relevant documents<\/li>\n\n\n\n<li>Filing to LHDN<\/li>\n\n\n\n<li>Application for state authority&rsquo;s consent approval (if any)<\/li>\n\n\n\n<li>Registration of your new ownership with the relevant state authority<\/li>\n<\/ul>\n\n\n\n<p>The appointment of a representing lawyer is <strong>required by the banks<\/strong> and you don&rsquo;t have to go through all the hassle and headache of documentation, especially if you&rsquo;re in the dark about it.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-ii-letter-of-offer-lo-booking-form-letter-of-confirmation-for-sale\">ii. Letter of Offer (LO)\/Booking Form\/Letter of Confirmation for Sale<\/h3>\n\n\n\n<p>This document is the <strong>first step<\/strong> in your property purchasing journey. <\/p>\n\n\n\n<p>This is the document that <strong>indicates the buyer&rsquo;s desire to purchase<\/strong> and the <strong>seller&rsquo;s willingness to sell. <\/strong><\/p>\n\n\n\n<p>This letter accounts for the <strong>relevant furnishings<\/strong> that come with the property, the <strong>agreed selling price<\/strong>, the <strong>agreed earnest deposit<\/strong>, the timeframe on <strong>when the SPA should be signed<\/strong> and any other <strong>pre-agreed conditions<\/strong> between the buyer and the seller.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-iii-sales-and-purchase-agreement-spa\">iii. Sales and Purchase Agreement (SPA)<\/h3>\n\n\n\n<p>The SPA is an important document that lists down the <strong>terms and conditions of the sale<\/strong> and <strong>purchase transaction<\/strong> such as the timeframe of transfer, condition of the property&rsquo;s title, ownership of the property, guarantees and warranties by the parties, as well as other terms relevant to the sale of the property.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-iv-facility-agreement\">iv. Facility Agreement<\/h3>\n\n\n\n<p>The Facility Agreement is the <strong>main loan agreement<\/strong> that you sign with your bank to confirm your mortgage loan. <\/p>\n\n\n\n<p>This would be <strong>separate from the SPA<\/strong> and may require the involvement of a <strong>different lawyer<\/strong>. <\/p>\n\n\n\n<p>We recommend checking with your designated bank for their panel lawyer list before making an appointment.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-v-memorandum-of-transfer\">v. Memorandum of Transfer<\/h3>\n\n\n\n<p>Finally, you get to sign the <strong>Memorandum of Transfer (MOT)<\/strong>, also known as Form 14A! What are the Fees Associated with the MOT?<\/h2>\n\n\n\n<p>As with everything, the MOT comes with a cost. Being one of the most important documents in the property purchase process, the MOT comes with an <strong><em>ad valorem<\/em> stamp duty charge<\/strong>. <\/p>\n\n\n\n<p>The <a href=\"https:\/\/iqiglobal.com\/blog\/stamp-duty-malaysia\/\" target=\"_blank\" rel=\"nofollow noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-text-link-color\">stamp duty<\/mark><\/a> is payable upon <strong>stamping of the MOT<\/strong>, which will happens before transfer of the title deeds to your name.&nbsp;<\/p>\n\n\n\n<p>Here&rsquo;s a breakdown of the stamp duty fees due upon stamping of the MOT:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td><span style=\"font-weight: 400; color: #000000;\"><strong>House price<\/strong><\/span><\/td><td class=\"has-text-align-center\" data-align=\"center\"><span style=\"font-weight: 400; color: #000000;\"><strong>Stamp duty fee<\/strong><\/span><\/td><\/tr><tr><td><span style=\"font-weight: 400; color: #000000;\">First RM100,000<\/span><\/td><td class=\"has-text-align-center\" data-align=\"center\"><span style=\"font-weight: 400; color: #000000;\">1%<\/span><\/td><\/tr><tr><td><span style=\"font-weight: 400; color: #000000;\">The next RM400,000:<\/span> <p><span style=\"font-weight: 400; color: #000000;\">RM100,001 &ndash; RM500,000<\/span><\/p><\/td><td class=\"has-text-align-center\" data-align=\"center\"><span style=\"font-weight: 400; color: #000000;\">2%<\/span><\/td><\/tr><tr><td><span style=\"font-weight: 400; color: #000000;\">RM500,001 &ndash; RM1,000,000<\/span><\/td><td class=\"has-text-align-center\" data-align=\"center\"><span style=\"font-weight: 400; color: #000000;\">3%<\/span><\/td><\/tr><tr><td><span style=\"font-weight: 400; color: #000000;\">RM1,000,001+<\/span><\/td><td class=\"has-text-align-center\" data-align=\"center\"><span style=\"font-weight: 400; color: #000000;\">4%<\/span><\/td><\/tr><\/tbody><\/table><figcaption class=\"wp-element-caption\"><span style=\"font-weight: 400; color: #000000; font-size: 12pt;\">Breakdown of the stamp duty fees<\/span><\/figcaption><\/figure>\n\n\n\n<p>To paint a clearer picture of the calculation, let&rsquo;s say a property was purchased at RM800,000. What will be the <strong>stamp duty fee<\/strong> imposed on the buyer?&nbsp;<\/p>\n\n\n\n<p><em>For the first RM100,000<\/em> = RM100,000 x 1% = RM1,000<\/p>\n\n\n\n<p><em>For the next RM400,000<\/em> = RM400,000 x 2% = RM8,000&nbsp;<\/p>\n\n\n\n<p><em>For the remaining amount<\/em> = RM300,000 x 3% = RM9,000&nbsp;<\/p>\n\n\n\n<p><strong><em>Total stamp duty imposed:<\/em><\/strong> RM1,000 + RM8,000 + RM9,000 = <strong>RM18,000&nbsp;<\/strong><\/p>\n\n\n\n<p>In this case, the buyer has to pay <strong>RM18,000<\/strong> for the stamp duty.&nbsp;<\/p>\n\n\n\n<p>As evident, the stamp duty fee can be quite a hefty sum. <\/p>\n\n\n\n<p>Luckily, the government currently provides <strong>stamp duty exemption<\/strong>, which is also given for the transfer of property by way of love and affection, which will be briefly mentioned below.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"640\" height=\"320\" src=\"https:\/\/iqiglobal-web-revamp.s3.ap-southeast-1.amazonaws.com\/wp\/blog\/wp-content\/uploads\/2024\/07\/19112804\/mot-img-4.webp\" alt=\"\" class=\"wp-image-113521\" srcset=\"https:\/\/iqiglobal-web-revamp.s3.ap-southeast-1.amazonaws.com\/wp\/blog\/wp-content\/uploads\/2024\/07\/19112804\/mot-img-4.webp 640w, https:\/\/iqiglobal-web-revamp.s3.ap-southeast-1.amazonaws.com\/wp\/blog\/wp-content\/uploads\/2024\/07\/19112804\/mot-img-4-300x150.webp 300w, https:\/\/iqiglobal-web-revamp.s3.ap-southeast-1.amazonaws.com\/wp\/blog\/wp-content\/uploads\/2024\/07\/19112804\/mot-img-4-370x185.webp 370w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><\/figure>\n<\/div>\n\n\n<h2 class=\"wp-block-heading\" id=\"h-5-when-do-i-pay-the-stamp-duty-fee-for-the-memorandum-of-transfer\">5. When Do I Pay The Stamp Duty Fee For The Memorandum of Transfer?<\/h2>\n\n\n\n<p>In most cases, the MOT is prepared alongside the <strong>Sales and Purchase Agreement (SPA)<\/strong> and <strong>relevant loan documents<\/strong> when a bank loan is taken out to purchase a property.&nbsp;&nbsp;<\/p>\n\n\n\n<p>However, it is important to note that if you are <strong>purchasing from a developer<\/strong> and the property is <strong>still under construction<\/strong>, the developer <strong>may not issue this MOT<\/strong> at the time of purchase until the land titles have been issued.<\/p>\n\n\n\n<p><strong>The buyer is responsible<\/strong> for the stamp duty fee, and not the seller. <\/p>\n\n\n\n<p>If the stamp duty is not paid, the transfer of ownership cannot be executed.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-i-property-transfer-between-family-members\">i. Property Transfer Between Family Members<\/h3>\n\n\n\n<p>Although it sounds romantic, the <strong>transfer of ownership of property between family members<\/strong> is legally recognized in Malaysia under the consideration of &lsquo;<strong>love and affection<\/strong>&rsquo;. <\/p>\n\n\n\n<p>In this case, stamp duty fees can either be <strong>partially or fully waived<\/strong>!<\/p>\n\n\n\n<p>Property transfers between <strong>spouses<\/strong> get to benefit from a <strong>100% stamp duty exemption<\/strong>. <\/p>\n\n\n\n<p>Transfers between <strong>(i) parents and child<\/strong>, and <strong>(ii) grandparents and grandchild<\/strong>, are subject to a different exemption. <\/p>\n\n\n\n<p>The <strong>first RM1,000,000<\/strong> of the property value is <strong>exempt from stamp duty<\/strong>, the <strong>remaining balance<\/strong> receives a <strong>50% exemption<\/strong>.<\/p>\n\n\n\n<p>Unfortunately, there is <strong>no stamp duty exemption<\/strong> for transfers between <strong>siblings and\/or relatives.&nbsp;<\/strong><\/p>\n\n\n\n<p>The MOT is still required to be <strong>stamped and adjudicated<\/strong> in these cases,
