{"id":30540,"date":"2021-05-06T11:21:55","date_gmt":"2021-05-06T03:21:55","guid":{"rendered":"https:\/\/www.iqiglobal.com\/blog\/?p=30540"},"modified":"2024-03-18T12:32:39","modified_gmt":"2024-03-18T04:32:39","slug":"apa-anda-perlu-tahu-mengenai-cukai-keuntungan-harta-tanah-ckht","status":"publish","type":"post","link":"https:\/\/iqiglobal.com\/blog\/bm\/apa-anda-perlu-tahu-mengenai-cukai-keuntungan-harta-tanah-ckht\/","title":{"rendered":"Apa Anda Perlu Tahu Mengenai Cukai Keuntungan Harta Tanah (CKHT)"},"content":{"rendered":"<!DOCTYPE html PUBLIC \"-\/\/W3C\/\/DTD HTML 4.0 Transitional\/\/EN\" \"http:\/\/www.w3.org\/TR\/REC-html40\/loose.dtd\">\n<html><body><h3>Apa maksud Cukai Keuntungan Harta Tanah (CKHT)?<\/h3>\n<p><span style=\"color: #000000;\">Cukai Keuntungan Harta Tanah (CKHT) atau <em>Real Property Gains Tax (RPGT) <\/em>adalah cukai yang dikenakan atas keuntungan bersih daripada pelupusan harta tanah (rumah pangsa, rumah, kondominium, pangsapuri, ladang, tanah kosong, dan lain-lain).&nbsp;<\/span><\/p>\n<p><span style=\"color: #000000;\">Berbeza dengan<\/span> <a href=\"https:\/\/iqiglobal.com\/blog\/ms\/panduan-duti-setem-2021-5-soalan-berkenaan-duti-setem\/\">Duti Setem<\/a>, <span style=\"color: #000000;\">CKHT merupakan cukai yang perlu dilunas apabila anda melupus hartanah anda.<\/span><\/p>\n<h3>Ringkasan mengenai CKHT<\/h3>\n<p><span style=\"color: #000000;\">CKHT\/RPGT ni sebenarnya dah diperkenalkan pada tahun 1976 di bawah&nbsp;<a href=\"https:\/\/www.hasil.gov.my\/bt_goindex.php?bt_kump=5&amp;bt_skum=5&amp;bt_posi=2&amp;bt_unit=1&amp;bt_sequ=1\" target=\"_blank\" rel=\"noopener\"><strong>Akta Cukai Keuntungan Harta Tanah 1976<\/strong><\/a>, dan mulai 21 Oktober 1988, cukai ini diperluaskan ke atas keuntungan daripada pelupusan syer dalam Syarikat Harta Tanah.<\/span><\/p>\n<p><span style=\"color: #000000;\">CKHT adalah cukai yang dikenakan oleh <a href=\"https:\/\/www.hasil.gov.my\/\" target=\"_blank\" rel=\"noopener\">Lembaga Hasil Dalam Negeri (LHDN)<\/a> pada keuntungan daripada pelupusan hartanah.<\/span><\/p>\n<p><span style=\"color: #000000;\">Setinggi 30% kadar keuntungan yang boleh dikenakan cukai, tapi ia bergantung kepada tempoh perolehan hartanah. Rumah tu dibeli pada tahun 2010 pada harga RM500,000. Jadi bagaimana kita nak ketahui CKHT yang kita perlu bayar? Pertama sekali ingat rumah tu sudah 11 tahun jadi berapa kadar CKHT yang perlu dibayar? Warganegara dan lebih 6 tahun, 5%.<\/span><\/p>\n<p><span style=\"color: #000000;\">Untuk memudahkan, kita pecahkan cara pengiraan kepada tiga bahagian.&nbsp;<\/span><\/p>\n<h4><span style=\"color: #000000;\">1. Kira keuntungan yang boleh kena cukai (C.G)<\/span><\/h4>\n<p><span style=\"color: #000000;\">Yang ni bahagian pertama. Kita perlu tahu dalam keuntungan kita tu, berapa yang layak dikenakan cukai. Formula dia adalah:<\/span><\/p>\n<table style=\"border-collapse: collapse; width: 100%;\">\n<tbody>\n<tr>\n<td style=\"width: 100%; background-color: #ffaf2e; text-align: center;\"><span style=\"color: #000000;\"><strong>Harga jual &ndash; harga beli &ndash; kos lain-lain = C.G<\/strong><\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><span style=\"color: #000000;\">Kos lain-lain bermaksud kos bayaran guaman atau yang berkait dengan pembelian hartanah dahulu. Contohnya kos bayaran guaman ialah RM10,000. Jadi:<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"color: #000000;\"><strong>RM700,000 &ndash; RM500,000 &ndash; RM10,000 = RM190,000<\/strong><\/span><\/p>\n<h4><span style=\"color: #000000;\">2. Kira keuntungan cukai bersih<\/span><\/h4>\n<p><span style=\"color: #000000;\">Selepas dah dapat angka RM190,000, seterusnya kita perlu kira keuntungan terkena cukai bersih. Formulanya:<\/span><\/p>\n<table style=\"border-collapse: collapse; width: 100%;\">\n<tbody>\n<tr>\n<td style=\"width: 100%; background-color: #ffaf2e; text-align: center;\"><span style=\"color: #000000;\"><span style=\"color: #000000;\"><b>Keuntungan yang boleh kena cukai &ndash; Pengecualian (RM10,000 atau 10% C.G mana yang lebih tinggi)<\/b><\/span><\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><span style=\"color: #000000;\">Pengecualian tu perlu pilih mana yang lebih tinggi, RM10,000 atau 10% dari C.G. Kalau mengikut kiraan ini 10% lebih tinggi. Jadi:<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"color: #000000;\"><strong>RM190,000 &ndash; (RM190,000 x 10%) = RM171,000<\/strong><\/span><\/p>\n<h4><span style=\"color: #000000;\">3. Kira cukai yang perlu dibayar<\/span><\/h4>\n<p><span style=\"color: #000000;\">Ha ni yang tertunggu-tunggu. Bahagian terakhir yang kita akan ketahui berapa CKHT yang kita perlu bayar kepada pihak LHDN. Pengiraan dia ialah:<\/span><\/p>\n<table style=\"border-collapse: collapse; width: 100%;\">\n<tbody>\n<tr>\n<td style=\"width: 100%; background-color: #ffaf2e; text-align: center;\"><span style=\"color: #000000;\"><span style=\"color: #000000;\"><b>Keuntungan cukai bersih X Kadar CKHT = Cukai yang perlu dibayar<\/b><\/span><\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><span style=\"color: #000000;\">Akhirnya kita dapat tahu berapa kadar CKHT yang perlu kita bayar.&nbsp;<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"color: #000000;\"><strong>RM171,000 x 5% = <span style=\"text-decoration: underline; color: #ff0000;\">RM8,550<\/span><\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Jadi selepas mengambil tahu kadar CKHT dan menggunakan 3 bahagian yang tertera, kita dapat tahu kadar CKHT yang perlu dibayar ialah <strong>RM8,550<\/strong> dan pembayaran harus dilakukan kepada pihak LHDN 60 hari dari pelupusan atau penjualan hartanah.<\/span><\/p>\n<p><span style=\"color: #000000;\">Mudah kan? Seperti:<\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\">Pengecualian ke atas keuntungan daripada penjualan hartanah kediaman satu sekali dalam seumur hidup kepada individu. <\/span><\/li>\n<li><span style=\"color: #000000;\">Pengecualian ke atas keuntungan daripada penjualan hartanah antara ahli-ahli keluarga (contoh: suami dan isteri, ibu bapa dan anak-anak dan datuk dan nenek dan cucu-cucu)<\/span><\/li>\n<li><span style=\"color: #000000;\">Rumah kos rendah, rumah kos sederhana dan rumah mampu milik bernilai bawah RM200,000 tidak dikenakan CKHT.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>10% <\/strong>daripada keuntungan ATAU&nbsp;<strong>RM10, 000<\/strong> bagi setiap transaksi (yang mana lebih tinggi) tidak dikenakan cukai.<br>\n<\/span><\/li>\n<\/ol>\n<h3>Cukai Keuntungan Harta Tanah (CKHT) pada Tahun 2020<\/h3>\n<h5><a href=\"https:\/\/www.mysumber.com\/bajet-2020.html\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #ff9900;\">Belanjawan 2020<\/span><\/a><\/h5>\n<p><span style=\"color: #000000;\">Sewaktu pengumuman Belanjawan 2020, kerajaan telah umumkan layanan baharu terhadap kadar CKHT. Dengan menggunakan nilai pasaran 1 Januari 2013 sebagai harga pemerolehan hartanah bagi hartanah yang diperoleh sebelum 1 Januari 2000.<\/span><\/p>\n<p><span style=\"color: #000000;\">Bagaimana maksudnya ni? Jom kita fahamkan.<\/span><\/p>\n<p><span style=\"color: #000000;\">Encik Ali membeli beli tanah pada tahun 1999 dengan harga RM200,000. Kemudian cadang untuk menjual tanah itu pada tahun 2020 dengan harga RM1juta. Harga pasaran pada tahun 2000 adalah RM500,000, manakala harga pasaran pada tahun 2013 adalah RM700,000.<\/span><\/p>\n<table style=\"border-collapse: collapse; width: 100%; height: 158px;\">\n<tbody>\n<tr style=\"height: 158px;\">\n<td style=\"width: 100%; background-color: #ffaf2e; height: 158px;\">\n<p style=\"text-align: center;\"><span style=\"color: #000000;\"><strong>Sebelum Belanjawan 2020:<\/strong><\/span><br>\n<span style=\"color: #000000;\">RM1,000,000 &ndash; RM500,000 = RM500,000<\/span><br>\n<span style=\"color: #000000;\">CKHT = RM500,000 x 5% = RM25,000<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"color: #000000;\"><strong>Selepas Belanjawan 2020:<\/strong><\/span><br>\n<span style=\"color: #000000;\">RM1,000,000 &ndash; RM700,000 = RM300,000.<\/span><br>\n<span style=\"color: #000000;\">CKHT: RM300,000 x 5 = RM15,000<\/span><\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><span style=\"color: #000000;\">Dengan penetapan kadar CKHT baharu yang dibentangkan sewaktu Belanjawan 2020, ianya sangat membantu pemilik rumah dengan pembayaran yang lebih murah.<\/span><\/p>\n<h5><a href=\"https:\/\/penjana.treasury.gov.my\/\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #ff9900;\">Pelan Jana Semula Ekonomi Negara (PENJANA)<\/span><\/a><\/h5>\n<p><span style=\"color: #000000;\">Pelan Jana Semula Ekonomi Negara (PENJANA) merupakan salah satu <a href=\"https:\/\/iqiglobal.com\/blog\/ms\/apa-itu-b40-m40-dan-t20-senarai-bantuan-2021\/\" target=\"_blank\" rel=\"noopener\">inisiatif bantuan oleh kerajaan<\/a> untuk membantu ekonomi negara. PENJANA telah menggariskan pengecualian CKHT bagi merancakkan pertumbuhan sektor hartanah.&nbsp;<\/span><\/p>\n<p><span style=\"color: #000000;\">Perkara itu secara rasminya digazetkan dalam warta kerajaan, menerusi Perintah Cukai Keuntungan Harta Tanah (Pengecualian) 2020, yang dibuat mengikut Akta Cukai Keuntungan Harta Tanah 1976:<\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\">Hanya untuk warganegara Malaysia<\/span><\/li>\n<li><span style=\"color: #000000;\">Pengecualian Cukai Keuntungan Harta Tanah (CKHT) bagi pelupusan rumah kediaman hanya pada 1 Jun 2020 hingga 31 Disember 2021.<\/span><\/li>\n<li><span style=\"color: #000000;\">Pengecualian cukai keuntungan itu bagi pelupusan kondominium, pangsapuri atau rumah pangsa, pangsapuri perkhidmatan dan pejabat kecil pejabat rumah (SOHO).<\/span><\/li>\n<li><span style=\"color: #000000;\">Terhad kepada <strong>tiga unit harta kediaman<\/strong> dalam tempoh berkenaan.<\/span><\/li>\n<li><span style=\"color: #000000;\">Perjanjian jual beli (SPA) hartanah kediaman yang dibuat pada atau selepas 1 Jun 2020 tapi tak lebih dari 31 Disember 2021 dan disetem paling lewat pada 31 Januari 2022.<\/span><\/li>\n<li><span style=\"color: #000000;\">Jikalau tiada SPA, instrumen pemindahan untuk penjualan hartanah kediaman dibuat pada atau selepas 1 Jun 2020 tetapi tidak lewat dari 31 Disember 2021, dan dicop sewajarnya tidak lewat dari 31 Januari 2022.<\/span><\/li>\n<\/ol>\n<h3>Cara nak bayar CKHT<\/h3>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-30456\" src=\"https:\/\/iqiglobal-web-revamp.s3.ap-southeast-1.amazonaws.com\/wp\/blog\/wp-content\/uploads\/2021\/04\/shutterstock_1960495075-300x153.jpg\" alt=\"\" width=\"551\" height=\"282\"><\/p>\n<p><span style=\"color: #000000;\">Mudah sahaja cara nak bayar CKHT.
