Jenis-jenis Kaveat di Malaysia&nbsp;<\/h2>\n\n\n\n<p>Undang-undang tanah di Malaysia, terutamanya melalui <a href=\"https:\/\/www.jkptg.gov.my\/my\/soalan-lazim-3\/43-faq\/pengurusan-tanah\/pengurusan-tanah-2\/1041-apa-itu-kanun-tanah-negara-ktn-1965\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Kanun Tanah Negara 1965 (KTN)<\/strong><\/a>, memperuntukkan beberapa jenis kaveat yang berbeza bergantung kepada siapa yang memasukkannya dan tujuan ia dimasukkan. &nbsp;<\/p>\n\n\n\n<p>Setiap jenis kaveat mempunyai <strong>ciri-ciri undang-undang<\/strong> tersendiri, tempoh kuatkuasa yang berlainan serta kesan berbeza ke atas pemilik tanah dan pihak ketiga.&nbsp;<\/p>\n\n\n\n<p>Adalah sangat penting bagi pemilik tanah, pembeli, institusi kewangan dan semua pihak berkepentingan memahami <strong>jenis-jenis kaveat<\/strong> ini supaya mereka tahu bagaimana ia berfungsi dan bagaimana ia boleh mempengaruhi urusan hartanah mereka.&nbsp;<\/p>\n\n\n\n<p>Berikut adalah <strong>empat jenis utama<\/strong> <strong>kaveat<\/strong> yang diiktiraf oleh KTN:&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th><strong>Jenis Kaveat<\/strong><\/th><th class=\"has-text-align-center\" data-align=\"center\"><strong>Siapa Boleh Memasukkan<\/strong><\/th><th class=\"has-text-align-center\" data-align=\"center\"><strong>Tujuan<\/strong><\/th><th class=\"has-text-align-center\" data-align=\"center\"><strong>Tempoh Kuatkuasa<\/strong><\/th><\/tr><\/thead><tbody><tr><td><strong>Kaveat Persendirian<\/strong>&nbsp;<\/td><td class=\"has-text-align-center\" data-align=\"center\">Individu\/syarikat berkepentingan<\/td><td class=\"has-text-align-center\" data-align=\"center\">Melindungi kepentingan seperti <strong>hak pembeli<\/strong> yang telah menandatangani perjanjian jual beli tetapi belum didaftarkan pindah milik.<\/td><td class=\"has-text-align-center\" data-align=\"center\"><strong>6 tahun<\/strong> (boleh dibatalkan atau dilanjutkan oleh mahkamah).<\/td><\/tr><tr><td><strong>Kaveat Pendaftar<\/strong>&nbsp;<\/td><td class=\"has-text-align-center\" data-align=\"center\">Pendaftar Hakmilik atau Pentadbir Tanah<\/td><td class=\"has-text-align-center\" data-align=\"center\">Melindungi <strong>kepentingan kerajaan<\/strong> atau pihak rentan seperti kanak-kanak, orang kurang upaya atau membetulkan kesilapan hak milik.<\/td><td class=\"has-text-align-center\" data-align=\"center\"><strong>Tiada tarikh luput<\/strong>; Apa Berlaku Jika Hartanah Anda Dikaveatkan?&nbsp;<\/h2>\n\n\n\n<p>Bagi pemilik hartanah, menerima notis bahawa hartanah mereka telah <strong>dikenakan kaveat<\/strong> boleh menimbulkan kekeliruan atau kebimbangan. &nbsp;<\/p>\n\n\n\n<p>Apakah yang sebenarnya berlaku apabila hartanah dikenakan kaveat?&nbsp;<\/p>\n\n\n\n<p>Sebagai pemilik tanah yang dikenakan kaveat:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Anda <strong>tidak boleh<\/strong> melakukan urus niaga baru.<\/li>\n\n\n\n<li>Anda akan menerima <strong>notis rasmi (<\/strong><a href=\"https:\/\/www.scribd.com\/doc\/38278966\/Borang-19C\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Borang 19C<\/strong><\/a><strong>)<\/strong> dari Pejabat Tanah.<\/li>\n\n\n\n<li>Tiada denda langsung, tetapi anda mungkin perlu <strong>menanggung kos undang-undang<\/strong> untuk pembatalan.<\/li>\n\n\n\n<li><strong>Nasihat peguam<\/strong> diperlukan segera.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>Pada ketika ini, mendapatkan nasihat daripada seorang peguam hartanah yang berpengalaman adalah <strong>langkah kritikal<\/strong> untuk menilai opsyen pembatalan yang ada.&nbsp;<\/p>\n\n\n\n<p>Terdapat beberapa <strong>cara pembatalan kaveat<\/strong> boleh dilakukan:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Rundingan Sukarela: <\/strong>Berunding dengan pengkaveat untuk menyelesaikan isu. Jika berjaya, mereka boleh menarik balik kaveat.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Permohonan Kepada Pendaftar (<\/strong><a href=\"https:\/\/chrome-extension\/\/efaidnbmnnnibpcajpcglclefindmkaj\/https:\/\/www.ptgwp.gov.my\/portal\/documents\/20182\/44908\/Borang_19H_new.pdf\/07f19fcf-5303-495c-b3f9-a316e3bd01d6\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Borang 19H<\/strong><\/a><strong>):<\/strong> Memohon kepada Pendaftar untuk membatalkan kaveat. <br>Pengkaveat akan diberi <strong>60 hari<\/strong> untuk mendapatkan perintah mahkamah bagi melanjutkan kaveat mereka. Jika gagal, kaveat akan dibatalkan.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Perintah Mahkamah:<\/strong> Jika rundingan dan permohonan Pendaftar gagal, anda boleh memohon kepada Mahkamah Tinggi untuk membatalkan kaveat. <br>Ini boleh mengambil masa dan melibatkan <strong>kos yang lebih tinggi<\/strong>, tetapi mungkin juga membolehkan tuntutan <strong>ganti rugi<\/strong> jika kaveat itu tidak berasas.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-5-proses-memasukkan-kaveat-persendirian\">5.
