Harta alih<\/strong><strong><br><\/strong>Contohnya termasuk wang simpanan bank, saham, pelaburan, kenderaan dan barang kemas.<\/p>\n\n\n\n<p><strong>ii. Harta tidak alih<\/strong><strong><br><\/strong>Ini termasuk aset seperti rumah, tanah, apartmen, kondominium atau premis perniagaan.<\/p>\n\n\n\n<p>Sebelum harta tersebut boleh dipindah milik kepada waris, beberapa perkara perlu diselesaikan terlebih dahulu seperti pembayaran hutang si mati, kos pengurusan jenazah serta proses pentadbiran pusaka.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-2-perbezaan-faraid-hibah-dan-wasiat\">2. Pembahagian ini ditentukan berdasarkan <strong>kadar tertentu<\/strong> kepada waris yang layak seperti pasangan, anak, ibu bapa dan saudara terdekat.<\/p>\n\n\n\n<p>Setiap waris mempunyai bahagian yang telah <strong>ditentukan oleh syarak<\/strong>. Sebagai contoh, anak lelaki biasanya menerima bahagian yang lebih besar berbanding anak perempuan.<\/p>\n\n\n\n<p>Pembahagian faraid hanya berlaku selepas beberapa perkara diselesaikan terlebih dahulu seperti:<\/p>\n\n\n\n<p>&bull; pembayaran hutang si mati<br>&bull; kos pengurusan jenazah<br>&bull; pelaksanaan wasiat (jika ada)<\/p>\n\n\n\n<p><strong>i) Rujukan Istilah Faraid<\/strong><\/p>\n\n\n\n<p>Sebelum kita mengira, mari fahami istilah penting ini:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>As-habul Furudh (Golongan VIP):<\/strong> Waris yang sudah ditetapkan bahagiannya (seperti 1\/8, 1\/4, 1\/6).\n<ul class=\"wp-block-list\">\n<li><strong>Contoh:<\/strong> Isteri, Ibu, Ayah.<br><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Asabah (Penerima Baki):<\/strong> Waris yang menerima baki harta selepas golongan VIP selesai.\n<ul class=\"wp-block-list\">\n<li><strong>Contoh:<\/strong> Anak Lelaki, Adik-beradik Lelaki seayah.<br><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Hijab (Pendinding):<\/strong> Waris terdekat yang menghalang waris jauh daripada mendapat bahagian.\n<ul class=\"wp-block-list\">\n<li><strong>Contoh:<\/strong> Kehadiran <strong>Anak Lelaki<\/strong> menyebabkan <strong>Adik-beradik<\/strong> si mati tidak mendapat harta (terhijab).<br><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Aul &amp; Radd (Penyelarasan):<\/strong> Digunakan apabila jumlah pengiraan unit tidak sama dengan jumlah harta.\n<ul class=\"wp-block-list\">\n<li><strong>Contoh:<\/strong> Jika hanya ada Ibu dan Isteri (Harta berlebih = <strong>Radd<\/strong>) atau jika waris terlalu ramai (Harta tak cukup = <strong>Aul<\/strong>).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p><strong>ii) Contoh Kes: Warisan RM1.2 Juta<\/strong><\/p>\n\n\n\n<p>Mari kita lihat bagaimana harta sebanyak <strong>RM1.2 Juta<\/strong> dibahagikan secara telus untuk waris: Isteri, Ibu, Seorang Anak Lelaki, dan Seorang Anak Perempuan.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Langkah 1: Menentukan Bahagian Asal (Asal Masalah: 24)<\/strong><\/h4>\n\n\n\n<p>Pada mulanya, kita mencari penyebut sepunya untuk Isteri (1\/8) dan Ibu (1\/6), iaitu <strong>24<\/strong>.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Isteri:<\/strong> 3 unit<\/li>\n\n\n\n<li><strong>Ibu:<\/strong> 4 unit<\/li>\n\n\n\n<li><strong>Baki (Asabah):<\/strong> 17 unit (untuk dikongsi anak-anak).<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Langkah 2: Proses &lsquo;Tasheh&rsquo; (Kenapa Jadi 72 Unit?)<\/strong><\/h4>\n\n\n\n<p>Oleh sebab 17 unit tidak boleh dibahagi tepat kepada anak lelaki dan perempuan mengikut (nisbah 2:1), kita darabkan keseluruhan pengiraan dengan 3 (24 x 3 = 72).<\/p>\n\n\n\n<p><strong>Inilah hasil akhirnya:<\/strong><\/p>\n\n\n\n<figure melibatkan hutang si mati, wasiat (maksimum 1\/3 harta kepada bukan waris), atau harta sepencarian.<\/p>\n\n\n\n<p style=\"font-size:17px\"><em><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-text-hover-color\">Nasihat:<\/mark><\/strong> <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-text-hover-color\"><strong>Sentiasalah merujuk kepada pakar faraid atau peguam Syarie untuk memastikan setiap sen dibahagikan mengikut lunas syarak yang sah.<\/strong><\/mark><\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-b-hibah\">b) Hibah<\/h3>\n\n\n\n<p>Hibah merujuk kepada <strong>pemberian harta secara sukarela<\/strong> oleh seseorang kepada individu lain semasa masih hidup.<\/p>\n\n\n\n<p>Sebagai contoh, seseorang boleh memberikan rumahnya kepada anak melalui hibah semasa hidup bagi mengelakkan sebarang pertikaian selepas kematiannya.<\/p>\n\n\n\n<p>Oleh sebab itu, hibah sering digunakan sebagai salah satu <strong>cara perancangan harta<\/strong> untuk mengelakkan pertikaian waris pada masa hadapan.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-c-wasiat\">c) Wasiat<\/h3>\n\n\n<div \/><\/figure>\n<\/div>\n\n\n<p>Wasiat ialah <strong>arahan bertulis<\/strong> yang dibuat oleh seseorang tentang <strong>bagaimana hartanya perlu dibahagikan selepas kematiannya<\/strong>.<\/p>\n\n\n\n<p>Bagi umat Islam, wasiat hanya boleh dibuat sehingga maksimum <strong>satu pertiga daripada jumlah harta pusaka<\/strong> dan tidak boleh diberikan kepada waris faraid tanpa persetujuan waris lain.<\/p>\n\n\n\n<p>Selepas seseorang meninggal dunia, wasiat akan dilaksanakan oleh individu yang dilantik sebagai <em>executor<\/em> atau <strong>pentadbir
